Welcome to HomeInsight AI. By using our website, mobile app, or services, you agree to these Terms of Service. If you don't agree, please don't use our platform.

HomeInsight AI is operated by NextGen Real Estate Technology, Inc. ("we," "us," or "our"), located in the San Francisco, California.

2. What We Do (And Don't Do)

HomeInsight AI is a technology platform that connects home buyers, sellers, and real estate agents. We provide:

• Property listings and search tools
• AI-powered disclosure analysis
• Blind bidding for property offers
• Document sharing and management
• Agent matching services

3. Your Account

To use our services, you must:

• Be at least 18 years old
• Provide accurate information when creating your account
• Keep your login credentials secure
• Notify us immediately if you suspect unauthorized access

You're responsible for all activity under your account. We may suspend or terminate accounts that violate these terms.

4. Blind Bidding

Our blind bidding feature allows buyers to submit offers on properties. Here's how it works:

• Bids are confidential—other buyers cannot see competing offers
• Sellers see bid amounts but buyer identities remain anonymous until acceptance
• Submitting a bid is a serious expression of intent to purchase
• Accepted bids may create binding obligations under California law

5. AI-Powered Features

Our AI features analyze property disclosures and provide insights. Important things to know:

• AI analysis is a preliminary tool to help you understand documents
• AI outputs are not professional advice (legal, engineering, or otherwise)
• Always verify AI findings with licensed professionals
• We don't guarantee AI analysis is complete or error-free
• AI may miss important issues or incorrectly flag non-issues
• Cost estimates are approximations and may vary significantly from actual costs

You can opt out of AI processing of your documents at any time through your account settings or by contacting us at help@homeinsightai.com.

6. Your Content

When you upload content (property listings, documents, photos), you:

• Keep ownership of your content
• Grant us permission to display and process it on our platform
• Confirm you have the right to share it
• Agree not to upload illegal, fraudulent, or misleading content

We may remove content that violates these terms or applicable laws.

7. Acceptable Use

You agree NOT to:

• Use the platform for fraud, spam, or illegal activities
• Scrape, harvest, or collect data without permission
• Impersonate others or provide false information
• Interfere with or disrupt our services
• Circumvent security measures
• Act as an unlicensed real estate broker through our platform

8. Fees and Payments

Most features are free for buyers. Some services may have fees:

• Premium listing features for sellers
• Agent subscription plans
• Transaction fees (clearly disclosed before purchase)

All fees are displayed before you commit. Payments are processed securely through Stripe.

9. Limitation of Liability

We work hard to provide a reliable service, but:

• Our platform is provided "as is" without warranties
• We're not liable for decisions you make based on our tools
• We're not responsible for third-party content or services
• Our liability is limited to fees you've paid us in the past 12 months (minimum $50)

This doesn't limit liability for things that can't be limited by law.

10. Indemnification

You agree to defend and hold us harmless from claims arising from your use of the platform, content you upload, or violations of these terms.

11. Changes to Terms

We may update these terms from time to time. We'll notify you of significant changes via email or a notice on our platform. Continued use after changes means you accept the new terms.

12. Termination

You can close your account anytime. We may suspend or terminate accounts that violate these terms. Upon termination, your right to use the platform ends, but these terms continue to apply to past use.

13. Governing Law

These terms are governed by California law. Any disputes will be resolved in courts located in San Francisco County, California.
